Replant seed is subject to availability of seed and specific selections are subject to supplies. Replant seed requires an affidavit signed by Roth Seed Company, Inc. dealer and retail customer. No return.
NOTICE TO BUYER—LIMITATION OF WARRANTY
ROTH SEED COMPANY, INC. and Dealer warrant that the seeds are as described on the bag and tag attached thereto; within tolerances, if any, established by law. Because the quality and quantity of crops depend on many conditions beyond our control; there are no warranties expressed or implied which extend beyond the description on the face of merchantability of fitness of the seed for any particular purpose. Hereof and all implied warranties of merchantability are hereby disclaimed and excluded. Nor any other warranty against loss of yield due to any cause; including, environmental conditions, disease, insect, soil conditions, farming practices or the response of any of RSC Seed to any such conditions. Roth Seed Company, Inc. liability for breach of warranty here under shall be limited solely to refund of the purchase price of the seed or replacement; thereof at Roth Seed Companys, Inc. options. Neither Roth Seed Company, Inc. nor their Dealer shall be liable under any circumstance for consequential or incidental damages. To avoid acceptance on these terms, the purchaser shall return the seed in its ORIGINAL, UNOPENED CONTAINER within 5 days after purchase and the purchase price will be refunded.
Before opening a bag of seed, be sure to read and understand the stewardship requirements, including applicable refuge requirements for insect resistance management, for the biotechnology traits expressed in the seed as set forth in the technology agreement that you sign. By opening and using a bag of seed, you are reaffirming your obligation to comply with the most recent stewardship requirements.
